OSHA Regulation of Low Exposure Carcinogens: A New Approach to Judicial Analysis of Scientific Evidence
Abstract
The current OSHA method for quantifying harms from toxics does not work as well as it should. Much of the problem lies with a judiciary that fails in sceintific literacy governing risk, exposure, and harm. This article suggests that a cadre of sceintific evidence judicial masters would be an appropriate way for federal courst reviewing risk regulation under OSHA to improve their understanding of the science of risk and exposure.
